As forms of evidence are constantly evolving—from text messaging, videoconferencing and cloud-based documents—it has become increasingly challenging for professionals to keep up with not only which data to collect, but how to effectively use it in their cases.
During CloudNine’s “Harnessing the Power of Modern Data” webinar on Aug. 10, e-discovery experts highlighted some of the challenges that come with the ever-growing sources of data and offered best practices to get ahead of modern data types.
1. Authenticate the Data, but Not in All Cases
Once the right data is collected, experts noted that attorneys shouldn’t underestimate the importance of authenticating it, especially as it has become easier to fabricate pieces of evidence.
While the authentication can take place during the litigation, Jerry Bui, managing director at FTI Consulting Technology, argued that it is more efficient to perform the forensic authentication as early on in the process as possible as it could catch crucial information for the case and ultimately save clients both time and money.
