Chicago ACEDS – Judges Panel – Emojis in eDiscovery

The Chicago chapter of ACEDS will be hosting an in-person event at the law firm of Barack Ferrazzano, in conjunction with the other mid-west chapters of ACEDS.

Kelly Twigger, principal at ESI Attorneys, will moderate a panel discussion featuring Judge Xavier Rodriguez, W.D of Texas and Judge William Matthewman, S.D. of Florida, on how emoji are impacting discovery and recent case law decisions.

Panelists:

United States Magistrate Judge William Matthewman

• Appointed to the federal bench in 2012 and sits in the West Palm Beach Division of the United States District Court for the Southern District of Florida.
• As a U.S. Magistrate Judge, he handles both civil and criminal cases, including pretrial matters and trials.
• Prior to joining the bench, Judge Matthewman was a very active trial attorney who handled both criminal and civil cases, including high profile cases which were covered on live in-session Court TV, Dateline, 48 Hours, and other programs.
• He was Board certified by The Florida Bar in criminal trial practice before his appointment to the bench and is AV rated by Martindale Hubbell.
• He has been a member of The Florida Bar and a trial lawyer since 1983, handling numerous cases in state and federal courts.
• He received his B.S. degree and Masters degree from Florida International University in Miami, and he received his Law Degree, with Honors, from the University of Florida College of Law. While at University of Florida Law School, he was Research Editor of the University of Florida Law Review.
• He has published several articles, including most recently the following law review article: William D. Matthewman, Towards A New Paradigm For E-Discovery In Civil Litigation: A Judicial Perspective, 71 Fla. L. Rev. 1261 (September, 2019). This Florida Law Review article deals with e-discovery and the 10 most important core concepts of the new e-discovery paradigm.

Xavier Rodriguez

• Former Texas Supreme Court Justice and currently sits on the bench as a United States District Judge for the Western District of Texas.
• Born in San Antonio, Texas, he received his bachelor’s degree from Harvard University, a master’s degree from the University of Texas LBJ School of Public Affairs and a Doctor of Jurisprudence degree from the University of Texas Law School.
• Prior to assuming the bench, he was a partner in the international law firm of Fulbright & Jaworski (now known as Norton Rose Fulbright).
• Judge Rodriguez is a frequent speaker on continuing legal education seminars and has authored numerous articles regarding employment law, discovery and arbitration issues.
• He is the editor of Essentials of E-Discovery (TexasBarBooks 2d ed. 2021).
• He is a member of The Sedona Conference Judicial Advisory Board, the Georgetown Advanced E-Discovery Institute Advisory Board, and serves as the Distinguished Visiting Jurist-in-Residence and adjunct professor of law at the St. Mary’s University School of Law.
• He was elected to membership in the American Law Institute and is a Fellow of the American Bar Foundation and the Texas Bar Foundation.
• In 2011 he was awarded the Rosewood Gavel Award for outstanding judicial service from the St. Mary’s University School of Law. In 2017, he received the State Bar of Texas Gene Cavin Award for Excellence in CLE, recognizing his long-term contributions to continuing legal education.
• In 2021, he was presented the Texas Bar Foundation’s Samuel Pessarra Outstanding Jurist Award and TexasBarCle’s Pat Nester Innovation in Professional Development Award.
• He is the Immediate Past Chair of the State Bar of Texas Litigation Section, Past Chair of the State Bar of Texas Labor and Employment Law Section and Past Chair of the State Bar of Texas Continuing Legal Education Committee.

Moderator:

Kelly Twigger is a practicing attorney, software developer, consultant, writer, and speaker on issues in electronic discovery, the development and implementation of legal technology, and how to effectively use data in planning for and during litigation.

She is a co-author of Electronic Discovery and Records and Information Management, and host of Case of the Week at eDiscovery Assistant. As Principal at ESI Attorneys, Kelly manages the boutique eDiscovery and information law firm that acts as operational business partners with its clients to advise law firms, corporations, and municipalities on all areas of electronic information including eDiscovery, privacy, cybersecurity, and information governance.

Kelly is also the CEO of eDiscovery Assistant — a SaaS-based practical resource for litigators handling eDiscovery — that curates discovery decisions, rules, and additional content. She is developing an online academy to provide on-demand education for lawyers and legal support professionals to stay abreast of changes in the law and technology that affect litigation and clients’ obligations to respond.
