Collaboration and communication technology forms have evolved considerably within the past 3 years. Traditional business environments across the United States and Globally are now utilizing heightened communication forms such as Slack, Quip and WhatsApp to increase chat efficiency and foster creative environments to encourage productivity. Technology hubs such as Silicon Valley are no longer isolated instances of communication technology variance. With this heightening and continued introduction of numerous forms of communication, new challenges have been raised during identification, collection and production of these non-standard data types for investigations and lawsuits. This webinar will use a hypothetical lawsuit where a team of engineers have been using three forms of emerging data sources for communication, which will need to be preserved, collected, reviewed and produced per the request for production from plaintiffs’ counsel. We’ll navigate the process, considerations and risks while we navigate this hypothetical scenario.

Presented by Alex Marjanovic who is a Senior Managing Director at Ankura based in Southern California. With more than 18 years of e-discovery, litigation management, and document review experience, Alex has overseen business development, the build-out of sales operations, and the post-acquisition integration of sales teams. His core expertise is managing sales-consultant teams and developing the workflows that enable in-house and outside counsel to streamline their data management, e-discovery, document review, and production protocols. Prior to joining Ankura, Alex was a managing partner of sales at a business services firm in their e-discovery and managed review division. Over seven years, he managed the business development executives, sales operations, and customer service teams who supported a client base of law offices and corporate legal departments throughout the southwestern U.S. These teams’ core services included information governance, early case assessment, data acquisition and forensics, ESI processing, database hosting, and technology-assisted review. Alex previously was the division sales manager at a legal services firm. He had been in a managerial role in e-discovery and document management group when his more recent company acquired this division. In the course of his career, Alex has served in a variety of sales and consulting roles, assisting clients with the evaluation and implementation of paper and electronic discovery strategies and workflows, and presenting CLE programs on a variety of litigation readiness and document review topics. His CLE presentations have included “Early Strategies for Successful Document Management”, “Paper Discovery in an Electronic World”, “I Think I Just Received Electronic Discovery: What Now?”, “How to Effectively Prepare for and Manage ESI in Civil Litigation” , “Outsourcing and the Duty of Competence” and “Collection of ESI & the Ethical Swamp”. These CLE programs have been presented to over 60 Law Firms and Legal Organizations, with over 900 attendees in the past three years alone. Alex is a graduate of the University of California at San Diego, from which he received a B.A. degree in Political Science, and has attended, participated in and obtained certifications in numerous advanced educational programs in electronic discovery, information governance and other course related topics. In Addition to his role at Ankura, Alex is Featured Faculty with Attorney Credits web-based CLE programs and is on the Advisory board for the Electronic Discovery Program at UC San Diego.

Presented by Mark Clews a Senior Managing Director at Ankura, based in Irvine. Mark has led hundreds of engagements on a wide variety of matters ranging from forensic analysis of a single machine through to multi-jurisdictional class action disputes containing hundreds of custodians. Mark has extensive experience navigating his clients through the challenges of responding to government and regulatory investigations, including the Securities and Exchange Commission, Consumer Financial Protection Bureau, Department of Justice, Environmental Protection Agency, Office of the Inspector General, Financial Industry and Regulatory Authority, Federal Trade Commission, and the Attorney General’s Office. His project experience includes investigating the operation of illegal cartels, theft of intellectual property, accounting irregularities, securities class actions, Qui Tam whistleblower suits, and other fraudulent activities.
