Gabe Landau: The New Discovery Operating Model.

Extract from Gabe Landau’s article, “The New Discovery Operating Model.”

In my last article, I wrote about why I think we’re looking at GenAI in eDiscovery too narrowly, particularly when we focus primarily on its application to document review.

For years, we’ve approached discovery through a fairly well-established process. Identify, preserve, collect, process, analyze, review, and produce. The technologies supporting those activities have evolved considerably, but much of the way we organize and execute the work has remained relatively consistent.

And to be clear, there’s nothing inherently wrong with that framework. We need structure, repeatable processes, and defensible methodologies.

But with the technologies available today, I think there’s an opportunity to reconsider how we actually execute the work.

What if, instead of organizing so much of the discovery process around moving documents from one stage to the next, we organized it around the decisions the legal team needs to make?
