A Georgia state court ruled in OpenAI’s favor in what may be the first-ever generative artificial intelligence defamation suit after a radio talk show host accused OpenAI’s chatbot product, ChatGPT, of inaccurately stating he was sued for embezzlement. Gibson, Dunn & Crutcher represented OpenAI.

Gwinnett County Superior Court Judge Tracie Cason issued an order granting summary judgment in full to OpenAI on Monday, almost two years after Mark Walters, a Georgia resident, Second Amendment activist and host of the nationally syndicated Armed American Radio show, sued OpenAI Inc. for allegedly inventing a fictional lawsuit against him that incorrectly claimed he had defrauded and misappropriated funds from the Second Amendment Foundation, a pro-gun rights advocacy organization.

Gibson Dunn declined to comment but directed Law.com to an OpenAI spokesperson, who said in an email, “We appreciate the court’s careful decision and its findings about our efforts to responsibly educate users and improve our models. ChatGPT is helping millions of people be more creative, learn faster and solve hard problems, and we’ll keep working to make sure it’s safe and helpful.”
