Extract from Kelly Twigger’s article “CaseoftheWeek Episode 96: Key Considerations for Issuing and Enforcing Third Party Subpoenas”
Episode 96 of the Case of the Week series discussed the recent case of Black v. Boomsourcing LLC, which was decided on January 24, 2023. This case comes before the Court on a motion to enforce a third party subpoena and has some interesting teaching moments for subpoenas under Rule 45 of the Federal Rules of Civil Procedure โ understanding how the burden works, timing and whether the 100 mile rule allows the served party to avoid compliance. Spoiler alert, the Court enforces the subpoena.

Another announcement of an event. This one is about the Academy of Court Appointed Neutrals event that is coming up March 10th in San Diego. This is the first of its kindโan annual meeting in which the participants will talk about how the profession of what folks have called special masters is being transformed in a way that creates many more opportunities and provides opportunities to meet with judges and other stakeholders. It is not limited to members.
